§1  General
1. Deliveries, services and offers of Far Out, Unipessoal Lda to consumers pursuant to § 13 BGB, will be made on the basis of these terms and conditions, if the order neither can be assigned to a commercial nor to a self-employed professional activity of the customer. By placing the order the customer agrees with this contractual basis .


2. The presentation of products in the online shop represents no legally binding offer, but only a non-binding online catalogue. By clicking on the button "Purchase Now" the customer submits a binding order of the products contained in the shopping cart. The confirmation of receipt of the order occurs together with the acceptance of the order by sending an automated email immediately after submission. The contract of sale is not achieved with this E-Mail confirmation. The conclusion of contract effects with our separate order confirmation or with the delivery of the goods. The conclusion of the contract is carried out exclusively in the German language.

We are usually available Monday through Friday from 10:00 to 18:00 and Saturday from 10:00 to 14:00.


4. All orders are stored at Far Out, Unipessoal Lda. The order data and the link to the terms and conditions will be sent to the customer by E-Mail. The customer can request copies of the data of previous orders from us by email or by phone .
5. The European Commission provides a platform for online dispute resolution (OS). The website can be found here.
We are not obligated and unwilling to participate in a dispute settlement procedure before a consumer arbitration board.

§2  Prices and Payment Terms
1. The prices apply when the binding order is placed. All prices include VAT and are exclusive of any applicable shipping costs. Costs for packaging are already included in the shipping costs.

2. In the case of deliveries to countries outside the European Union, additional costs may be incurred in individual cases which the seller is not responsible for and which are to be borne by the customer. These include, for example, costs for the transfer of money by credit institutions (eg transfer fees, exchange rate charges) or import duties or taxes (eg customs duties). Such costs may be incurred in relation to the transfer of funds even if the delivery is not made to a country outside the European Union, but the customer makes the payment from a country outside the European Union.

3. The payment option (s) will be communicated to the customer in the online shop of the seller.

4. If payment is made using a payment method offered by PayPal, payment will be processed through the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal") the PayPal Terms of Use, available at https://www.paypal.com/uk/webapps/mpp/ua/useragreement-full or, if the customer does not have a PayPal account, under the terms and conditions of payments without PayPal Account, available at https://www.paypal.com/webapps/mpp/ua/privacywax-full.

5. Delivery within Germany is free of charge up to a weight of 31.5 kg. Shipping costs to other countries can be found under "Payment and Shipping".

§3  Delivery
1. For consumers within the meaning of § 13 BGB, the risk of accidental loss and accidental deterioration of the sold item is also transferred to the consignment purchase only with the transfer of the thing to the customer. The delivery will be made to the delivery address specified by the customer.

2. If the customer chooses advance payment and the amount of money is not credited to the account of Far Out, Unipessoal Lda within five days, Far Out, Unipessoal Lda can withdraw from the contract. Insofar as Far Out, Unipessoal Lda adheres to the contract, the delivery deadlines stated at the time of ordering no longer apply. Rather, instead of the delivery date originally specified, the one which is stated for the product at the time of receipt of the money in the catalog of goods of "www.myhifishop.de".

3. The availability of the goods and their dispatch date are shown in the electronic goods catalog. Each delivery is subject to the proviso that Far Out, Unipessoal Lda itself is supplied on time and properly. Far Out, Unipessoal Lda will make every reasonable effort to obtain the goods. If, contrary to expectations, a product ordered by the customer is not available despite timely disposition for reasons for which Far Out, Unipessoal Lda is not responsible, the customer will be informed immediately about the unavailability and the customer will be refunded without delay in the event of withdrawal.

§4  Withdrawal for Consumers
 You have (as a consumer according to §13 BGB) the right to revoke this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods, the last partial shipment or the last part.

by means of a clear statement (eg a letter sent by post, fax or e-mail) about your decision to withdraw from this contract. You can use the attached model withdrawal form or provide another clear explanation.
In order to maintain the cancellation period, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of the cancellation

If you withdraw from this Agreement, we have selected all payments we have received from you, including delivery charges (except for the additional costs arising from your choosing a different delivery method than the standard delivery offered by us have to repay immediately and at the latest within fourteen days from the date on which the notification of your revocation of this contract has reached us. For this repayment, we use the same means of payment that you used in the original transaction, unless otherwise agreed with you; In no case will you be charged for this repayment fees.
We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return the goods to us immediately and in any event not later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send the goods before the deadline of fourteen days.
You bear the immediate costs of returning the goods.
You only have to pay for a possible loss in value of the goods, if this loss of value is due to a handling that is not necessary for the examination of the nature, characteristics and functioning of the goods.

Exclusion of the right of withdrawal
The right of withdrawal does not exist with contracts

- for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or provision by the consumer is authoritative or which are clearly tailored to the personal needs of the consumer,

- for the delivery of sealed goods, which are not suitable for return for reasons of health or hygiene, if their seal has been removed after delivery,

- for the supply of goods, if, due to their nature, they were inseparably mixed with other goods after delivery,

- for the delivery of sound or video recordings or computer software in a sealed package, when the seal has been removed after delivery,

- for the delivery of newspapers, magazines or magazines other than subscription contracts.

2. Extended 30-day money back guarantee

In addition to the statutory 14-day cancellation right Far Out, Unipessoal Lda offers for consumers (according to §13 BGB) a subsequent 16-day right of return. You can return the goods you receive without giving a reason within 30 days.
The cancellation period is 30 days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last goods, the last partial shipment or the last part.
For the cancellation after 30 days, the same conditions apply as for the legal withdrawal after 14 days
(See Point 1.)

§5 Warranty and damages
1. Defects or damages resulting from culpable or improper handling or improper installation as well as the use of unsuitable accessories or alterations of the original parts by the customer or a third party not commissioned by Far Out, Unipessoal Lda are excluded from the warranty.

2. The warranty period for new items is 24 months. The period begins with transfer of risk. The warranty period for used goods is different 12 months, unless the liability for injury to life, body and health unlimited liability.

3. For the rest, the warranty is based on the statutory provisions.

§6 No liability for data loss
The buyer is obliged to secure the data on the goods before the return. We are not responsible for the loss of data on devices sent back to us.

§7 Due date
1. The invoices of Far Out, Unipessoal Lda are, unless otherwise agreed in writing, immediately and without deduction payable. When paying by direct debit / direct debit, the actual debit takes place with preparation of the invoice before shipping the goods.

2. Far Out, Unipessoal Lda reserves the right to refuse checks and other non-cash means of payment. Acceptance is always only as payment. Payments in foreign currency are credited according to bank account. Bank charges are to be borne by the customer.

3. If the customer defaults on payment of the purchase price, the sum of the purchase price during the delay shall be subject to interest at five percentage points above the respective base interest rate. If a higher damage caused by default has demonstrably occurred, Far Out, Unipessoal Lda is entitled to assert this.

§8 Retention of title
1. The delivered goods remain the property of Far Out, Unipessoal Lda until full payment of the purchase price.

2. The customer is not entitled to sell the goods to third parties until full payment of the purchase price or to take other measures which endanger the property of Far Out, Unipessoal Lda. In the case of pledges, assignments of security or other access by third parties to the reserved goods, the buyer will point out the property of Far Out, Unipessoal Lda and notify us immediately
